Critical Safety Disclosure
CannCare may disclose your information to emergency services (Police, Ambulance, Fire) or social services without your prior consent when we reasonably believe:
- You are at immediate risk of serious harm to yourself
- Another person is at immediate risk of serious harm
- There is a safeguarding concern involving a child or vulnerable adult
- We are legally required to do so by court order or law
- There is a medical emergency requiring immediate intervention
We will only share the minimum information necessary and will inform you of any such disclosure as soon as reasonably practicable, unless doing so would increase the risk of harm.

We cannot and do not guarantee any specific outcome from our advocacy work. Results vary and are beyond our control.
1 Acceptance of Terms
By accessing or using CannCare, you agree to be bound by these Terms of Service in their entirety. If you do not agree to these Terms, you must immediately cease all use of the Service.

3 Service Description
CannCare provides information, advocacy, and educational resources relating to medical cannabis in the United Kingdom. Our services include:

- Liaison with clinics on your behalf
What We Do NOT Provide:
- Medical prescriptions, diagnoses, or treatment plans
- Legal representation or advice in any legal proceedings
- Guaranteed outcomes for any advocacy work
- Any form of regulated professional advice
4 No Warranties
The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, CannCare and Phytoventures Ltd disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Any warranty of merchantability or fitness for a particular purpose
- Any warranty that the Service will be uninterrupted, timely, secure, or error-free
- Any warranty as to the accuracy, reliability, or completeness of any information provided
- Any warranty that any outcomes, results, or benefits will be achieved
5 No Guarantee of Outcomes
You expressly acknowledge and agree that:
- CannCare cannot and does not guarantee any specific outcome from our advocacy work, case handling, or any other service we provide.
- Success in one case does not guarantee or imply success in any other case. Each situation is unique and outcomes depend on many factors beyond our control.
- Workplace, legal, medical, and other outcomes are determined by third parties and are beyond CannCare's control.
- You acknowledge that advocacy efforts may not resolve your situation or achieve your desired outcome.
6 Limitation of Liability
To the fullest extent permitted by UK law, Phytoventures Ltd, its directors, officers, employees, agents, and affiliates shall not be liable for any of the following, whether arising from contract, tort (including negligence), strict liability, or otherwise:
- Any decisions made based on CannCare information or advice
- Any actions taken or not taken as a result of using the Service
- Any outcomes from advocacy work or case handling
- Loss of employment, income, earnings, or business opportunities
- Legal costs, fines, penalties, or adverse judgments
- Medical complications, health outcomes, or treatment results
- Emotional distress, psychological harm, or mental anguish
- Any indirect, incidental, special, consequential, or punitive damages
Maximum Liability: Where liability cannot be excluded by law, our total aggregate liability to you for all claims shall not exceed £100 (one hundred pounds sterling).
7 Indemnification
You agree to indemnify, defend, and hold harmless Phytoventures Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service
- Your breach of these Terms
- Your violation of any applicable law or regulation
- Any third-party claims related to your use of the Service
- Any information or content you provide to us

By using CannCare, you acknowledge, confirm, and agree that:
- I understand that CannCare provides general information and advocacy only, not professional advice
- I will seek independent professional guidance from qualified professionals for my specific circumstances
- I am solely responsible for my own decisions and actions
- I will not hold CannCare liable for any outcomes resulting from my use of the Service
- I understand that advocacy does not guarantee any specific results

11 UK Cannabis Law
Cannabis remains a controlled substance under the Misuse of Drugs Act 1971. Medical cannabis may only be lawfully prescribed by specialist doctors on the GMC Specialist Register.
Important: We do not promote or encourage the unlawful use of cannabis. You are solely responsible for ensuring your activities comply with all applicable laws. CannCare accepts no liability for any legal consequences arising from your actions.
12 Force Majeure
CannCare shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, pandemics
- Government actions or changes in law
- Technical failures, cyber attacks, power outages
- Industrial action, civil unrest, terrorism
13 Data Protection

14 Fraud Prevention & Account Verification
To protect our community and maintain platform integrity, CannCare conducts user verification and fraud prevention measures. By using our Service, you acknowledge and agree that:
- CannCare may conduct background verification using your email address and name
- Third-party identity verification services may be used to verify your identity
- Verified concerns may result in permanent internal records that cannot be accessed or contested
- Providing false information during registration may result in permanent account restrictions

15 Termination & Service Blacklisting
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever at our sole and absolute discretion. This includes, but is not limited to, breach of these Terms or fraud prevention concerns.
Upon termination, your right to use the Service will immediately cease. Furthermore, we reserve the right to blacklist you from all Phytoventures Ltd owned and operated services for any reason at our sole discretion.
Blacklist records are maintained internally for serious violations and are not shared externally.
You acknowledge that we shall not be liable to you or any third party for any termination or blacklisting of your access to our services.
16 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CannCare regarding your use of the Service and supersede any prior agreements or understandings.
18 Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
